Terms of Service

By using homeposted.com or engaging HomeInvestor LLC for services, you agree to these terms. Home Posted is a brand of HomeInvestor LLC. If you are accepting on behalf of a company, you represent that you have authority to bind that company.

Home Posted provides a for-sale-by-owner listing platform, optional offer-request service, and clerical transaction coordination. Sellers choose the offer types and terms they will consider. Independent buyers make offers directly to sellers. Home Posted is not a real estate broker, real estate agent, mortgage lender, mortgage broker, mortgage loan originator, investment adviser, or insurance carrier. We do not take loan applications, originate loans, underwrite credit, hold funds, negotiate terms, interpret contracts, or give legal or financial advice. Any forms, calculators, or offer estimates on the platform are informational tools, not loan applications, financial advice, or binding offers. Final offers are made by an independent buyer and are subject to that buyer's own diligence, title review, and walk-through.

How we're paid. Listing a property and requesting an offer are free. There is no percentage commission. Where transaction coordination is offered and legally enabled, an eligible seller agrees to a disclosed flat coordination fee before the sale begins. The title company shows that fee as a separate seller-paid line on the closing statement and sends it from sale proceeds only after closing. There is no upfront transaction fee and nothing is owed if the deal does not close. Some grandfathered listings or transactions may be fee-exempt.

Publishing a self-service listing and requesting an offer have no upfront charge. Optional Full-Service Verified listing work is separately priced and purchased before that work begins. On any sale, the signed offer, purchase agreement, and closing statement control who pays title, recording, transfer, inspection, repair, and other costs. Home Posted covers closing costs, repairs, or cleanout only when those items are expressly included in a direct purchase offer.

Investor credit packs & paid services. Investors and buyer partners may purchase lead credits and other paid services on Home Posted. Payments are processed by Stripe, Inc. All charges appear on your statement as billed by Home Posted. Applicable sales tax, VAT, or GST is calculated at checkout based on your billing location. Payment, billing, refunds, and chargeback mechanics are governed by Stripe's Consumer Terms and our Refund Policy.

By requesting an offer, you authorize Home Posted to verify your information, pull public county records on the property, and share it with a local acquisitions partner if needed to make a written offer. We do not pull your credit.

• Provide accurate and complete information about the property and your ownership.
• Use the platform only for lawful sale of property you own (or have authority to sell).
• Be at least 18 years old and able to convey clear title (or working toward it).
• Read every offer, purchase agreement, and addendum carefully before signing.

If you post a For-Sale-By-Owner (“FSBO”) listing on Home Posted, you are solely responsible for its content and represent that you own (or are authorized to sell) the property.

Fair Housing Act. You may not post any listing, photo, headline, or description that indicates a preference, limitation, or discrimination based on race, color, religion, sex, familial status, national origin, disability, sexual orientation, or source of income (including Section 8 housing vouchers in jurisdictions where it is protected). Examples of prohibited language include “no kids,” “adults only,” “Christian buyers preferred,” “no Section 8,” and similar phrases. We screen listings on submit and may remove, unpublish, or refuse any listing at our sole discretion. Repeated violations result in account termination and, where required by law, a report to HUD.

Other prohibited content. No fraudulent listings, properties you do not own or have authority to sell, duplicate spam, MLS-protected content posted without an IDX license, or content that violates any law.

License. By posting a listing you grant HomeInvestor LLC a worldwide, non-exclusive, royalty-free license to display, distribute, and use the content (including photos) to operate and promote the marketplace.

Reporting. Anyone can report a listing for Fair-Housing violations, fraud, or inaccuracies using the “Report this listing” link on every detail page. We review reports within one business day.

Content on Home Posted, including calculators and articles, is for general information only and is not financial, legal, or tax advice. We do not guarantee that we will make an offer on every property, or that any offer will close at the indicated number, final offers are subject to title review, walk-through, and verification of property facts.

You consent to receive disclosures, notices, and account documents electronically, and to sign transaction documents electronically through our partners, consistent with the federal E-SIGN Act and applicable state UETA laws.

TCPA consent. When you submit a form on Home Posted that includes a phone number and the consent checkbox, you expressly consent to be contacted by Home Posted and the qualified independent buyer teams disclosed on the form at the number provided, including by autodialer, prerecorded or artificial voice messages, and SMS, about your property. Consent is not a condition of any purchase. You may opt out at any time by replying STOP to any text, clicking unsubscribe in any email, or emailing support@homeinvestor.co. Message and data rates may apply.

The platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or that calculator estimates will match an actual written offer. Offers are subject to title review, walk-through, and verification of property facts.

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability arising out of or relating to the services is capped at one hundred U.S. dollars ($100) or the amount you paid directly to us in the preceding 12 months, whichever is greater.

You may stop using the platform and close your Home Posted account at any time by emailing support@homeinvestor.co. We may suspend or terminate accounts for fraud, abuse, or violation of these Terms. Executed purchase agreements with us (or a referred acquisitions partner) survive termination of your Home Posted account and are governed by the purchase agreement itself.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. The exclusive venue for any dispute that is not subject to arbitration is the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.

Binding individual arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Home Posted will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in New Castle County, Delaware (or by video/telephone at the consumer's election). Small-claims court matters and claims for injunctive or other equitable relief to protect intellectual property are excluded.

Class action waiver. You and Home Postedagree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You may opt out of this arbitration agreement by emailing support@homeinvestor.co within 30 days of first accepting these Terms.

We may update these Terms. Material changes will be posted at this URL. Continued use of the site or services after a change constitutes acceptance.
